These Terms and Conditions apply to all event services provided by Osmic Productions Pty Ltd, including AV production, lighting, sound, staging, vision, special effects, photo booths, DJs, MCs, performers, entertainers, technicians, operators, event attendants, delivery, setup, operation and pack-down services.

By accepting a quote, approving a proposal, paying a deposit, issuing a purchase order, requesting an invoice or confirming a booking in writing, the Customer agrees to these Terms and Conditions.

1. Definitions

In these Terms and Conditions:

Osmic Productions, We, Us or Our means Osmic Productions Pty Ltd ABN 37 650 540 033.

Customer, You or Your means the person, company, organisation, venue, agency or entity booking or receiving services.

Services means any event production, AV, entertainment, staffing, technical, creative, equipment, delivery, setup, operation or pack-down service provided by Osmic Productions.

Staff means any DJ, MC, performer, entertainer, musician, technician, operator, event attendant, delivery crew, setup crew, pack-down crew, employee, contractor or subcontractor arranged by Osmic Productions.

Booking means a confirmed engagement for Services.

Fee means the total amount payable for the Services, including any equipment, labour, staffing, delivery, travel, setup, operation, pack-down, supplier, overtime, parking, idle time or additional charges.

2. Booking Confirmation

A Booking is confirmed once the Customer accepts a quote, pays a deposit, issues a purchase order, requests an invoice, or confirms approval to proceed in writing.

Once a Booking is confirmed, Osmic Productions may allocate staff, reserve equipment, decline other work, begin planning, arrange suppliers and schedule logistics.

The Customer is responsible for checking that all details on the quote, invoice, proposal or booking confirmation are correct.

3. Services Provided

Osmic Productions provides event production, AV, entertainment, equipment and staffing services for private, corporate, venue, public, school, community and special events.

The specific services included in each Booking are limited to the items listed in the accepted quote, proposal or invoice.

Anything not listed is not included unless confirmed in writing by Osmic Productions.

4. Staff, DJs, Entertainers and Contractors

All DJs, entertainers, performers, technicians, operators and event staff are booked through Osmic Productions.

Some staff may be independent contractors and not employees of Osmic Productions.

The Customer must not make private arrangements, changes, overtime agreements, payment arrangements or additional requests directly with staff unless approved by Osmic Productions management.

Any additional time, scope change, overtime or extended service must be approved by Osmic Productions management and may incur additional charges.

5. Payment

All Fees must be paid in accordance with the invoice or payment schedule.

Unless otherwise agreed in writing, full payment is required no later than 3 business days before the event.

Osmic Productions may cancel, suspend or refuse to provide Services where payment has not been received by the due date.

Credit card payments may incur merchant processing fees.

6. Cancellations, Postponements and Refunds

All cancellations, postponements and refund requests are handled in accordance with our Payment, Cancellation, Postponement and Refund Policy.

Confirmed bookings may incur cancellation or postponement fees, even where payment has not yet been made, if a quote has been accepted, a purchase order has been issued, an invoice has been requested, or written approval to proceed has been provided.

7. Event Details and Customer Information

The Customer must provide accurate event details, including:

  • event date;
  • venue and room name;
  • event start and finish time;
  • bump-in and bump-out times;
  • access details;
  • loading dock information;
  • parking arrangements;
  • run sheet;
  • floor plan;
  • technical requirements;
  • entertainment requirements;
  • power availability;
  • venue restrictions;
  • permits or approvals;
  • contact person onsite.

Osmic Productions is not responsible for issues caused by incorrect, incomplete or late information supplied by the Customer, venue, planner, agency or third party.

8. Run Sheets, Content and Technical Information

The Customer must provide final run sheets, content files, music requirements, presentation files, cue sheets and technical briefs within a reasonable timeframe before the event.

Late changes, missing files, incorrect file formats, untested content, changed run sheets or additional requirements may result in additional charges or reduced ability to deliver the requested outcome.

Osmic Productions is not responsible for errors in content supplied by the Customer or third parties.

9. Setup, Pack-Down and Access

The Customer must provide safe, clear and reasonable access for delivery, setup, operation and pack-down.

Additional charges may apply for:

  • difficult access;
  • stairs;
  • long carries;
  • lift delays;
  • loading dock delays;
  • restricted access;
  • waiting time;
  • parking fees;
  • return visits;
  • additional labour;
  • after-hours access;
  • early setup;
  • late pack-down;
  • split shifts.

Where access is delayed or restricted, Osmic Productions is not responsible for any reduction in setup time, service quality or event readiness caused by that delay.

10. Venue, Permits and Approvals

The Customer is responsible for obtaining all venue approvals, council approvals, permits, licences and permissions required for the event.

This includes approval for sound, lighting, staging, special effects, cold sparks, smoke, haze, dry ice, CO₂ effects, confetti, rigging, outdoor equipment, generators, electrical use, pyrotechnic-style effects, filming, music and entertainment.

Osmic Productions is not responsible for cancellations, restrictions or changes imposed by the venue, council, fire wardens, building management, security, police, emergency services or other authorities.

11. Power Requirements

The Customer must provide safe and suitable power for the Services unless power supply is specifically included in the quote.

Osmic Productions is not responsible for power failure, insufficient power, unsafe circuits, overloaded circuits, venue electrical faults or equipment shutdown caused by inadequate power.

If generators, power distribution, additional cabling or electrical support are required, these must be quoted separately.

12. Safety and Behaviour

Osmic Productions reserves the right to refuse, stop, pause or terminate Services if staff, guests, equipment or property are placed at risk.

This includes, but is not limited to:

  • unsafe behaviour;
  • intoxicated or aggressive behaviour;
  • damage to equipment;
  • unsafe weather;
  • unsafe power;
  • blocked exits;
  • unstable structures;
  • overcrowding;
  • interference with staff or equipment;
  • failure to follow safety directions.

No refund will be provided where Services are stopped or limited due to safety concerns or unacceptable behaviour.

13. Special Effects

Special effects may include cold sparks, dry ice, smoke, haze, CO₂, confetti, lasers, lighting effects or other production effects.

Special effects are subject to venue approval, safety requirements, suitable operating conditions and technician availability.

Some special effects cannot be dry hired and must be operated by Osmic Productions staff.

Osmic Productions is not liable for venue refusal, alarm activation, sprinkler activation, smoke detector activation, residue, cleaning requirements or restrictions where the Customer has not obtained proper approval or has provided incorrect information.

14. Outdoor Events and Weather

For outdoor events, the Customer must provide safe conditions and suitable protection for equipment and staff.

Osmic Productions may refuse to set up or operate equipment in unsafe weather, including rain, wind, lightning, flooding, unstable ground or extreme heat.

The Customer remains responsible for costs incurred where an event is cancelled, delayed or reduced due to weather or unsafe conditions.

15. Meals, Refreshments and Parking

For staffing bookings of 3 hours or more, the Customer must provide reasonable access to water and refreshments.

For longer events, the Customer may be required to provide meals for staff, technicians, DJs or performers.

The Customer must provide suitable parking or cover all parking costs.

16. Overtime and Additional Time

Overtime is subject to staff and equipment availability.

Overtime must be approved by Osmic Productions management and paid before or immediately after the additional service period, unless otherwise agreed.

Overtime rates may vary depending on the service, staff type, event date and timing.

17. Marketing Images and Video

Osmic Productions may capture photos or video of its equipment, setup, staff or event delivery for internal records and marketing purposes.

If the Customer does not want images or videos used publicly, this must be advised in writing before the event.

18. Limitation of Liability

To the maximum extent permitted by law, Osmic Productions is not liable for indirect, incidental, consequential or economic loss, including loss of profit, loss of opportunity, reputational loss, event disruption, guest dissatisfaction or loss caused by third parties, venue restrictions, weather, power failure or Customer error.

Where Osmic Productions is found liable, liability is limited to the amount paid by the Customer for the specific service giving rise to the claim.

19. Indemnity

The Customer indemnifies Osmic Productions, its directors, employees, contractors and agents against any claim, loss, damage, injury, cost, expense or liability arising from the event, venue, guests, third parties, unsafe conditions, incorrect information, breach of these Terms or misuse of equipment.

20. Breach of Terms

If the Customer breaches these Terms, Osmic Productions may:

  • cancel the Booking;
  • refuse to provide Services;
  • stop Services during the event;
  • retain payments made;
  • recover unpaid amounts;
  • refuse future bookings.

21. Governing Law

These Terms are governed by the laws of Queensland, Australia.

The Customer submits to the jurisdiction of the courts of Queensland, Australia.

  • Equipment Hire Terms and Conditions;
  • any quote, proposal, invoice or written agreement issued by Osmic Productions.
